PRO Agreements

PRO agreements are contracts that bind two actors having a role of representation / management of a catalog in different territories. The contract will thus govern the relationship between an original publisher and his sub-publisher, a substituted publisher and his sub-publisher, an original publisher and his administrator for a catalog of works. Consequently, the contract is attached to the assignee of a catalog of foreign works, which he represents in a given territory in the name and place of the original publisher, or of an intermediary.

The importance of this contract is well known. It legally justifies the chain of rights and therefore the right of assertion of the assignee.

In other words, this contract governs the assignee’s role in a catalog of works: his commission on editing rights for a given time in a specific territory.

The PRO guarantor of the fair transfer of the rights issued, must know all the actors present on a work, the role of each and the rules established between them. .

To facilitate the processing of works, certain PROs code the contracts. The codification is specific to each authors” society. The same contract, if it concerns several territories, will be assigned different codes according to the PRO with which it is registered.

The codification of the contracts is preliminary to the registration of the catalog of works which it governs. The assignee of the contract shall:

  1. send the contract to the PRO
  2. wait for an answer
  3. enter the code in le Sage
  4. enter both parties
  5. export works for registration

Entering the PRO agreement

In PRO agreement -> list of all the PRO agreements you have entered.

1. Contract PRO : the PRO that has given the code Type CWR : for subpublishing, original contract,… Code : code given by the PRO Date begining the contract : date you received the PRO agreement Ending date : in case of the termination of contracts

2. Assignor Code : IPI/CAE code of the original publisher/administrator Name : publisher’s/administrator’s name

3. Assignee Code : IPI/CAE code of the sub-publisher/administrator Name : sub-publisher’s/administrator’s name

CGP1 import - SACEM

CGP1 format Write to depot.contrat@sacem.fr and ask for the « CGP1 Detail » (the « CGP1 list » is useless)

Upload the file via « SACEM » -> Import contracts SACEM- CGP1

The PRO agreement will be automatically entered.

Using PRO agreements

After its publication, the general contract must be attached to the assignee for the works it governs. This information can be filled in a single work by opening its form: located the actor in Copyright and add in the column « PRO agreement » the contract by selecting it from the drop-down menu.

If the catalog submitted in management for a given territory is composed of several works, the action can be carried out by the constitution of a group of work. Once the group is created go to « Actions on Actors ». Choose the transferee actor for the catalog with the role of « administrator » or « sub-publisher » and attach a PRO agreement on a given territory. The contract will be attached to him for all works in the catalog.

Important : CWR registration

If the copyright of a work includes a substitute publisher / administrator that you represent as a sub-publisher, the PRO agreement that must be attached to you is the contract which binds the original publisher to the substituted publisher, for your CWR registration.
